Terms of Service

These Terms of Service ("Terms") are a binding agreement between you and SunSite ("the app", "the Service", "we", "us", or "our") governing your use of the SunSite iOS app. Please read them carefully. If you do not agree to these Terms, do not use the app.
1. Acceptance of these terms
By downloading, installing, or using SunSite, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated here by reference. If you are using SunSite on behalf of a company or other organization (for example, as a solar installer acting for your employer), you represent that you have the authority to accept these Terms on that organization's behalf, and "you" refers to both you and that organization.
You must be able to form a legally binding contract to use the Service. The app is not directed to children under 13, and it is not intended for their use.
2. What SunSite is
SunSite is an iOS app for solar installers and homeowners to run a fast on-site shade survey of a roof and produce a client-ready PDF report estimating the roof's annual solar access — that is, how much of the year's available sunlight the roof receives after accounting for shade.
The app works by letting you trace obstructions (such as trees, buildings, and hills) against the open sky using your phone's camera, and then computing the sun's path for the site's location and date. SunSite runs fully on your device: it has no backend server of its own, no user accounts, and no third-party tracking. To learn exactly how your data is handled, see our Privacy Policy. SunSite relies on Apple Maps (MapKit) for satellite imagery and address search, and on Apple's App Store (StoreKit) for subscriptions. Your use of those features is also subject to Apple's applicable terms and privacy policy.
3. Estimates and "AS IS" — please read this carefully
This section is important to how you may rely on SunSite. By using the app, you acknowledge and agree to the following.
SunSite's outputs are estimates
SunSite produces estimates intended for planning, sales, and illustration. The annual solar-access figures and reports the app generates are approximations, not exact measurements of a roof's real-world performance.
Not a certified or "bankable" engineering report
A SunSite report is not a certified, stamped, or "bankable" engineering report, and it is not a substitute for a professional site assessment, for structural or electrical engineering, or for a shade analysis performed with certified instruments. You should not present a SunSite report as any of those things.
Results depend on the measurements you take
The accuracy of SunSite's output depends directly on the accuracy of the measurements you capture on site — including the obstructions you trace, the angles you read, and the location and date you provide. You are responsible for verifying any critical values before relying on them or sharing them with a client.
What SunSite does not assess
SunSite does not assess, and its reports do not address:
- Roof access or safe working conditions;
- Structural integrity or load-bearing capacity;
- Electrical wiring or code compliance;
- Permitting, regulatory, or installation feasibility.
These remain the responsibility of qualified professionals. You agree that any installation, financing, or purchasing decision is yours to make based on appropriate professional advice, and not on a SunSite estimate alone.
4. Subscriptions and billing
Some features of SunSite require a paid subscription, SunSite Pro, which is an auto-renewing subscription sold through Apple's App Store.
- Plans and pricing: Monthly at $39 per month, or Yearly at $399 per year, each with a 7-day free trial for new subscribers.
- Auto-renewal: Your subscription renews automatically at the end of each billing period unless you cancel at least 24 hours before the period ends. Your payment method is charged through your Apple account upon renewal.
- Billed and managed by Apple: Apple processes all payments through StoreKit. SunSite never sees your payment card, bank details, or Apple ID. We do not control, and are not responsible for, Apple's billing.
- Managing or cancelling: You can view, manage, or cancel your subscription, and turn off auto-renewal, at any time in your App Store account settings. Cancellation takes effect at the end of the current billing period.
- Free trial: If you do not cancel before your 7-day free trial ends, it converts to a paid subscription and your Apple account is charged.
- Refunds: Purchases and refunds are handled by Apple under Apple's terms; we generally cannot issue refunds directly.
Apple's Media Services Terms and Conditions govern the purchase transaction itself. Prices may change; any change to subscription pricing will apply only to future billing periods, consistent with App Store rules.
5. Acceptable use
You agree to use SunSite only for lawful purposes and in accordance with these Terms. You agree that you will not:
- Use the app in any way that violates applicable laws or regulations, or that infringes the rights of others;
- Misrepresent a SunSite estimate as a certified, stamped, or professionally verified assessment;
- Reverse engineer, decompile, or disassemble the app, except to the extent that applicable law expressly permits despite this limitation;
- Interfere with, disrupt, or attempt to gain unauthorized access to the app or any systems or networks it connects to;
- Use the app to capture or store data about people or property without any consent that the law requires you to obtain.
You are responsible for the customer names, addresses, photos, and other information you choose to enter into the app, and for handling that information in line with your own legal obligations.
6. Intellectual property
Our property
The SunSite app, its software, design, branding, text, graphics, and all other content we provide are owned by us or our licensors and are protected by intellectual property laws. Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the app on Apple devices you own or control. We reserve all rights not expressly granted to you.
Your property
The survey data and reports you create with SunSite — including your projects, the customer names and addresses you type, the photos you take, GPS coordinates, roof outlines, and the PDF reports the app generates — are yours. As described in our Privacy Policy, this data is stored locally in the app's private storage on your device, and we do not collect, transmit to ourselves, or sell it. You are free to share, export, or delete your survey data and reports at any time.
7. Disclaimer of warranties
To the fullest extent permitted by law, the app and all of its outputs are provided "AS IS" and "AS AVAILABLE", without warranties of any kind, whether express, implied, or statutory. We specifically disclaim all implied warranties, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the app will be uninterrupted, error-free, or that any estimate it produces will match real-world results. Some jurisdictions do not allow the exclusion of certain warranties, so some of these exclusions may not apply to you.
8. Limitation of liability
To the fullest extent permitted by law, in no event will SunSite be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or business opportunities, arising out of or relating to your use of (or inability to use) the app or its outputs — including any reliance on an estimate — even if we have been advised of the possibility of such damages.
To the fullest extent permitted by law, our total aggregate liability arising out of or relating to the app or these Terms will not exceed the greater of (a) the amount you paid us for SunSite Pro in the twelve months before the event giving rise to the claim, or (b) fifty U.S. dollars ($50). Some jurisdictions do not allow certain limitations of liability, so some of these limits may not apply to you.
9. Indemnification
You agree to indemnify and hold harmless SunSite from and against any reasonable claims, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your misuse of the app, your violation of these Terms, your violation of any law or the rights of a third party, or your reliance on or presentation of a SunSite estimate in a manner inconsistent with Section 3.
10. Governing law
These Terms are governed by the laws of the United States and the laws of the State of Ohio, without regard to its conflict-of-laws principles. You agree that the state and federal courts located in Ohio will have jurisdiction over any dispute arising out of or relating to these Terms or the app, except where applicable law gives you the right to bring a claim elsewhere.
11. Changes to these terms
We may update these Terms from time to time — for example, to reflect changes to the app or to legal requirements. When we do, we will revise the "Last updated" date at the top of this page and post the new version at this address. Material changes will take effect when posted. Your continued use of the app after the changes take effect means you accept the updated Terms. If you do not agree, please stop using the app.
